2. Important Medical Disclaimer

Content on this site (blog posts, condition / treatment information, FAQ) is general health information only — not medical diagnosis, treatment, or any form of patient–practitioner relationship.For any health question or emergency, call 911 or go to your nearest ER.

All HealthKey clinical services require an in-person initial evaluation by a licensed acupuncturist, herbalist, or physical therapist. Browsing the site alone does not create a care relationship.

3. Site Services

  • This site offers: clinic info, practitioner bios, service catalog, pricing transparency, blog content, online booking entry, insurance verification form, contact form.
  • Actual appointments are completed via the Fresha third-party platform under their own payment terms.
  • Insurance verification is a pre-check estimate; final coverage depends on your carrier's day-of confirmation and your specific policy.

4. Your Responsibilities

  • Provide truthful, accurate, current personal information (contact, insurance, health history).
  • Do not submit unlawful, harassing, misleading, or fraudulent material.
  • Do not attempt to hack, scan, or disrupt the site or other users.
  • Do not copy, redistribute, or commercially reuse our content without written permission.
  • No automated bulk submissions (bots, scripts) against any form.

5. Intellectual Property

All content on this site (text, images, video, design, the "HealthKey" mark, practitioner portraits, blog posts) is owned by HealthKey Group and protected by US and international copyright + trademark law. Personal non-commercial citation is permitted (with "via healthkeygroup.com" attribution and a link). Commercial reuse, bulk scraping, and inclusion in AI training datasets are prohibited absent written permission.

6. Third-Party Links

  • This site links to Fresha, Google Maps, social media (Instagram / Facebook / Xiaohongshu), our herbal-product store (product.healthkeygroup.com), and insurance carrier sites.
  • These third-party services are outside our direct control. Use is governed by their own terms and privacy policies.
  • We are not responsible for third-party content, availability, or security.

7. Limitation of Liability

To the maximum extent permitted by law:

  • The site and its content are provided "as is" without warranty (express or implied — including merchantability, fitness for a particular purpose, non-infringement).
  • We are not liable for indirect, incidental, special, or punitive damages from site outages, content errors, or third-party conduct.
  • For any claim arising from this site, our maximum liability is the total fees you paid HealthKey in the prior 12 months; if no payment relationship exists, no more than USD $100.

In-clinic medical malpractice coverage is provided by our professional liability insurance and licensure regime — separate from these site Terms.

8. Indemnification

If your breach of these Terms (misuse, false data, third-party rights infringement) causes us to incur any claim, loss, or attorney fees, you agree to indemnify and hold us harmless.

9. Termination

We may suspend or terminate your access to the site at any reasonable time, without prior notice, for breach, misuse, automated attacks, or suspected fraud.

10. Governing Law & Disputes

These Terms are governed by New York State law (without regard to its conflict-of-laws rules). For any dispute:

  1. Both parties will first attempt good-faith written resolution within 30 days.
  2. Unresolved disputes go to the state or federal courts located in New York County (Manhattan), which have exclusive jurisdiction.
  3. You waive any class-action right (where law permits); any dispute must be brought individually.

11. Changes to These Terms

We may update these Terms at any time, with the new version posted here under a new "Last updated" date. Material changes (rights or obligations) trigger a banner or email notice. Continued use means acceptance.

12. Entire Agreement / Severability

These Terms plus the referenced policies constitute the full agreement between you and HealthKey regarding site use. If a court invalidates any clause, the rest remain in force.
